1.Introduction

Welcome to the SparkX Foundation (“SparkX”, “we”, “our”, “us”). We are a registered Non-Profit Company (NPC) in South Africa, focused on enabling self-system transformation through accessible, psychosocially grounded interventions.

By engaging with any of our services, content, programs, interventions or platforms—whether as a visitor, donor, partner, or participant—you agree to these Terms of Service (“Terms”).

Please read them carefully. If you do not agree, we kindly ask that you refrain from using our services.

2. Purpose of the Foundation

The SparkX Foundation exists to:

  • Make personal development accessible to all who value it.
  • Foster collective change through group coaching, storytelling, and dialogue.
  • Develop scalable psychosocial interventions and content that bridge the individual and the systemic.
  • Channel donations and resources toward our impact-driven programs.

SparkX Foundation is values-driven, grounded in systems psychodynamics, and guided by the principle that self-work is nation’s work, “we are because the I becomes.”

3. Scope of Use

These Terms apply to anyone who:

  • Visits our official website or attends SparkX Foundation events
  • Participates in any SparkX Foundation initiative (e.g. SparkxWalks, SparkxNation, SparkxSessions, SparkxCollabs, SparkxHumanity etc.)
  • Donates to the Foundation
  • Engages with SparkX Foundation as a collaborator, volunteer, or supporter

These Terms do not govern use of our digital volunteering coaching platform (Sparkx). Those are covered under a separate Terms of Use document.

4. Respectful Engagement

All engagement with SparkX Foundation—whether through group coaching, dialogues, events, volunteering or collaboration—must align with our core values:

  • Respect for diverse perspectives and lived experience
  • Confidentiality in appropriate contexts
  • Integrity in participation and representation
  • Safety for all involved in shared spaces

Discriminatory, harmful, or disruptive behaviour will not be tolerated and may result in removal from our spaces or events.

5. Donations and Funding

SparkX Foundation is funded through public and private donations. All contributions support our mission to scale access to self-system transformation-enabling psychosocial tools, platforms and interventions.



Donations:

  • Are voluntary and non-refundable unless explicitly stated
  • Are directed toward general operating support and earmarked for specific SparkX Foundation initiatives
  • May be acknowledged publicly unless anonymity is requested

SparkX is a registered NPC and in the process of applying for PBO (Public Benefit Organisation) status to offer Section 18A tax certificates in South Africa. Until approved, donations may not be tax-deductible.

6. Intellectual Property

All original content produced or shared by SparkX Foundation (including but not limited to articles, videos, interviews, toolkits, visual materials, insights, books, and program structures) is protected by intellectual property law.

Content may not be reproduced, modified, or distributed without prior written permission.
You are welcome to share publicly available content with proper attribution.

7. Communications and Data

We respect your privacy and comply with South Africa’s Protection of Personal Information Act (POPIA). If you subscribe to our newsletter, register for events, or donate, we may collect and store personal information solely for engagement and reporting purposes.

We do not sell or misuse your data. You can opt out of communications at any time.

8. Limitation of Liability

The SparkX Foundation and its directors, staff, volunteers, and affiliates are not liable for any direct, indirect, incidental, or consequential damages resulting from your participation in or reliance on our services or content.

We are a reflective learning organisation, not a clinical or emergency service provider.

9. Changes to Terms

These Terms may be updated from time to time to reflect organisational, legal, or strategic changes. Updated terms will be published on our website. Continued engagement with the Foundation constitutes acceptance of any revised Terms.
